Chapter 2: Why Do I Have to Sign Before I Commit?

We’re now three months into working under the new real estate law, and I’ve been out in the field meeting clients and showing properties. While a few buyers have heard of the law, most have questions and uncertainties. I found myself explaining the changes over and over, so today I’m sharing the top five questions I’ve been asked. This way, you can get a clear understanding of what this law means for you.
The number one question I’ve been getting is, “Why do I have to sign before I commit?” One of the reasons this law occurred was the lack of transparency around how and who pays the buyer agent. Now, before agents can show a house, this must be presented upfront. The form clarifies what the brokerage amount is and who is paying it.

Chapter 3: What Happens if I Refuse to Sign?

Question number two: “What happens if I refuse to sign anything?” Agents simply cannot show you the house. Keep in mind, though, you don’t have to commit to a long-term timeframe. You can sign for a one-time showing for a specific property.
However, be aware that if an agent agrees to show you a home without this signed agreement, they are breaking the law and could face severe penalties, including losing their real estate license.

Chapter 4: Can I Go Directly to the Listing Agent to Save Money?

Question number three: “Can I just go directly to the listing agent and save some money?” Yes, you can—but before you jump into that, here are some things to consider. The listing agent works for the seller and is obligated to get the best deal for them. If you have a buyer agent, they can negotiate on your behalf and potentially save you money through creative solutions.
