Follow the show for new episodes every week and together we'll grow and help even more folks. Hey, everyone. It feels. So good to be behind this microphone. It's been a while. I sure have missed you, and I'm so grateful to be back. The Scott family has had a handful of unexpected events recently. Life has a way of tossing things at us when we least expect it. Some are hard, some are confusing, and some just don't make a bit of sense. But through it all, we hold on. We keep moving forward and trust that there's a purpose in it all. Over my lifetime in real estate, I've seen a lot of changes and while I didn't always understand them at the time, looking back, I can honestly say most of those changes made things better. Change isn't always easy, but it sure can bring growth. I. Today we're gonna talk about one of those changes, an important update that took effect right here in the state of Alabama on April the 18th, 2025. If you're buying a home or even thinking about it, this episode is especially for you. I'm going to walk through the recent changes to our buyer agency laws. And talk about what it means for both buyers and sellers moving forward. The biggest and most talked about change is this. Buyers in Alabama are no longer required to sign our buyer agency agreement before Turing properties. Yay. That's right. If you've ever felt uneasy or pressured to sign something before you are ready, this is a welcome shift. Now, real estate agents can show you homes without requiring that formal agreement. Upfront that I talked about in episode four. This allows buyers more freedom to explore, get a feel for the market, and most importantly, find an agent who truly fits their needs without feeling locked in too soon. This new law offers flexibility and empowers buyers to make more informed decisions without unnecessary pressure. Now, with this new flexibility, there are still a couple of important forms you may see early in the process. But these are mainly for informational purposes to help you understand how your agent is representing you. One key document here in Alabama, which we have had in Alabama since the 1990s, is called the rec ad Form that stands for Real Estate Consumers Agency and Disclosure Act. Now, don't let that fancy title throw you off in simple terms. This form just simply outlines the different hats your real estate professional might wear. For example, a single agent represents only one side, either the buyer or the seller. If you're a buyer and you choose to work with a single agent, you typically sign a buyer agency agreement that explains how the agent gets paid and what their services include. Then there's the transaction broker role. You know, in this case, the agent doesn't really represent either party directly. They act more like a facilitator, helping with the paperwork, answering questions, and assisting with negotiations without giving advice or advocating for one side. Then you'll see. Subagent, which 99% of realtors do not use anymore, but it's still listed on the form. And finally, there is the limited consensual dual agent. This is when the same agent represents both the buyer and the seller in a transaction. It's only allowed when both parties are aware of it and agree to it in writing before any contract negotiation start. While it might sound tricky. It can work smoothly when handled with integrity and transparency no matter what role your agent plays or what hat they wear. Alabama law requires all real estate licensees to treat every client honestly and in good faith. If they're expected to exercise reasonable care and skill, keep your confidential information private unless otherwise required, present all written offers quickly and answer your questions accurately and completely. Even if you haven't signed an agency agreement, you know there's still a lot an agent can legally and ethically do for you. They can provide information on listings, show you properties, help you write up an offer, even explain financing options. However, until you sign a formal brokerage agreement, the law considers your agent a transaction broker, not a representative acting solely on your behalf. There is also one additional document that must be shown to you by law before you tour any home. It's called the. Office policy form this outlines how the real estate company provides brokerage services. You'll be asked to sign it, but keep in mind your signature simply acknowledges that you've received it and you're not committing to anything. Both the A form and the office policy form must be presented to you before you move forward with writing an offer and while your signature is not required. Agents are expected to provide these documents in a timely and trackable way. That's part of what the Alabama Real Estate Commission is now monitoring more closely, making sure agents are documenting and timestamping these steps correctly. It's all about accountability, transparency. And consumer protection. Woo. I know that was a mouthful, but you needed to hear it. So what does this change mean for you as a buyer? For starters, it offers more freedom. You are no longer tied down by an agency agreement before you even know. If you like the house or if you like the agent, you can take your time. You can shop around and you can compare agents before committing. That reduces pressure and builds trust naturally. It also improves communication because when things are clearly laid out up front, especially how your agent is compensated, it eliminates confusion and helps prevent conflict down the line. It's simply a win for everyone. As we start to wrap up, you know, I always love to end with a little mama, wisdom and inspiration because real estate may be my business, but life is where the real lessons are. Just like in real estate, life doesn't always go the way we planned. You can prepare, you can pray and plan your heart out, and still find yourself on a detour you didn't expect. But the foundation makes all the difference. When you're rooted in faith, hope and love, no storm can shake us completely. If you're in a season of waiting or standing in a place you've never imagined you'd be, I want to remind you that God isn't surprised he's still working behind the scenes. There's purpose in your pause, even if you can't see it yet. There's a verse that sits framed over my desk for the past 30 years, and it's carried me through many seasons of uncertainty. It's Isaiah 40 31. And says For those who hope, when the Lord will renew their strength, they will soar on wings like eagles. They will run and not grow weary. They will walk and not faint.
